Holding a Nursing Home Liable for Elder Abuse
Case Summary: 82-year-old Mary B., a widow from Pennsylvania, sustained extensive visible bruising and dehydration, as well as severe emotional distress due to separate incidents of neglect and abuse at a well-known nursing home. Her daughter reached out to the National Injured Senior Law Center when she saw multiple injuries without explanation and her mother began exhibiting behavioral problems.
Our Strategy: The legal team immediately began our investigation, and obtained medical records as well as testimony from staff and other residents through depositions and witness interviews. We consulted medical experts, deposed multiple employees, and researched similar cases where nursing homes were found to have severely neglected their residents. We then built a highly persuasive argument for Mary and her family.
The Result: As the result of skillful negotiations and presenting evidence that demonstrated the broad problem of overworked staff and understaffing at their facility, we were able to obtain a settlement for Mary and her family in the amount of $950,000. Further, new training programs for staff will be put in place along with monitoring devices to ensure further problems do not arise.

Owing Justice to a Senior Injured by a Faulty Medical Device
Frank L., a 77-year-old Ohio retiree, had hip replacement surgery where a widely used medical device was implanted. Months later, Frank began experiencing pain, had trouble getting around, and eventually needed revision surgery. As it turned out, our team discovered his device had been the subject of a nationwide recall.

Winning Damages for Mistakes in Assisted Living Medicines
Case Summary: Gloria S. was admitted to an assisted living facility in Florida for memory care. She sued the facility for a prescription error during which the pharmacy supplied her with the incorrect drug and continued to do so for two weeks before the staff discovered the problem and addressed it. The error caused some hospitalization and permanent health consequences.
Our Strategy: We carefully analyzed pharmacy records, facility logs, and other medical records. We documented that the pharmacy error was due to a lack of cross-checking policies and inadequate training for the staff responsible for administering medications. We arranged for the testimony of experts and pointed out systemic failures to validate our claims of negligence.
Result: Gloria’s family won a $675,000 settlement supporting ongoing medical care and compensating for her pain and suffering. The facility also agreed to implement stricter medication administration policies.

Getting Compensation to a Senior Fall Victim
Case Study: James H. is an 80-year-old veteran from Maryland. One morning, he slipped and fell in the apartment building lobby when his foot went out from under him on a puddle of water. We were contacted by the family of Elizabeth R., a Georgia woman, who died from sepsis caused by neglected bedsores while she was hospitalized. The facility in question initially refused to accept liability for the death because of Elizabeth’s pre-existing conditions. Our lawyers had the medical records analyzed, obtained expert medical testimony reflecting blatant neglect and delayed treatment. We next coordinated with Elizabeth’s family to show the impact on the plaintiff and her family. The case settled for $1.5 million, and included damages for funeral expenses, loss of consortium, and mental suffering. The hospital also implemented a new patient observation protocol as part of the settlement. Not only did Elizabeth’s family get justice for her but the changes that the hospital made will hopefully lessen the chances that any similar elderly patient of theirs will go through what she went through.
